The EPA is proposing law that will make our cars illegal to operate as of July 2016

As I understood it, this was proposed for factory made cars so they couldn't be upgraded/modified from the factory setup. I didn't read the whole thing, so maybe I missed the part where it specifically pointed out kit cars.

(5) Certified motor vehicles and motor vehicle engines and their emission control devices must remain in their certified configuration even if they are used solely for competition or if they become nonroad vehicles or engines; anyone modifying a certified motor vehicle or motor vehicle engine for any reason is subject to the tampering and defeat device prohibitions of paragraph (a)(3) of this section and 42 U.S.C. 7522(a)(3).

The EPA is adding new language to the regulations. This new language states that a motor vehicle can never be modified, even if it is used solely for competition and never again used on public roads. The EPA is seeking to prohibit modifications affecting any emissions-related component, such as engines, engine control modules, intakes, exhaust systems, etc.

The proposal would give the EPA the power to enforce against any vehicle owner that converts his or her emissions-controlled motor vehicle into a vehicle to be used solely for competition.



It is the EPA’s position that they will be able to enforce against vehicles that have already been converted in the past.
 
Repeated references are made to vehicles "used solely for competition". However this was stated only because the general consensious originally was that racing vehicles would be exempt from these same regulations directed toward all street driven vehicles with a VIN number . This added verbiage was to clarify that not only were street driven cars / engines affected...but even those built exclusively for racing which used engines originally manufactured for production vehicles were also affected.

IF...the racing vehicle was built from new, never registered components that were never used in a production vehicle...they could be exempt.
....The EPA agrees that vehicles that were originally manufactured for racing are excluded from regulation under the Clean Air Act. However, the EPA believes this exclusion extends only to vehicles that were never certified for on-road use or issued a VIN.

So...any engine used in a Kit car which came from a production street car having a VIN would fall under these new restrictions and be banned.
Or...any vehicle previously assigned a VIN after construction... would fall under these restrictions and be banned.

These regulations also will specifically go after manufacturers of aftermarket parts used for racing...effectively eliminating the aftermarket industry which supplies parts used in modification.

It is important that all of our elected officials understand that this proposal scheduled to go into effect in July 2016...should NOT be implemented.
It is noteworthy that the EPA can make these changes without restriction. They have that power. Only after these rules are implemented can the Congress overturn these regulations.

SEMA is working hard to lobby against these regulations...but the public needs to be just as vocal.

This proposal... if enforced as scheduled.... would forever change the entire automotive culture as we know it in America.

It is rare to see abject stupidity on display like this EPA proposal and all motorsport fans need to help defeat this.

Washington, DC (February 8, 2016) – The U.S. Environmental Protection Agency (EPA) has proposed a regulation to prohibit conversion of vehicles originally designed for on-road use into racecars. The regulation would also make the sale of certain products for use on such vehicles illegal. The proposed regulation was contained within a non-related proposed regulation entitled “Greenhouse Gas Emissions and Fuel Efficiency Standards for Medium- and Heavy-Duty Engines and Vehicles—Phase 2.”

The regulation would impact all vehicle types, including the sports cars, sedans and hatch-backs commonly converted strictly for use at the track. While the Clean Air Act prohibits certain modifications to motor vehicles, it is clear that vehicles built or modified for racing, and not used on the streets, are not the “motor vehicles” that Congress intended to regulate.

“This proposed regulation represents overreaching by the agency, runs contrary to the law and defies decades of racing activity where EPA has acknowledged and allowed conversion of vehicles,” said SEMA President and CEO Chris Kersting. “Congress did not intend the original Clean Air Act to extend to vehicles modified for racing and has re-enforced that intent on more than one occasion.”

SEMA submitted comments in opposition to the regulation and met with the EPA to confirm the agency’s intentions. The EPA indicated that the regulation would prohibit conversion of vehicles into racecars and make the sale of certain emissions-related parts for use on converted vehicles illegal. Working with other affected organizations, including those representing legions of professional and hobbyist racers and fans, SEMA will continue to oppose the regulation through the administrative process and will seek congressional support and judicial intervention as necessary.

SEMA has started a White House petition demanding that the EPA remove this proposal. We need to get 100,000 signatures in order for the White House to respond. This car is a Factory Five Mk1 Roadster that was registered and driven on the street as well as raced successfully at drag races.

This is precisely the type of BS YOU CAN ELIMINATE by voting for Constitution Party candidates! Yep. you heard me right. STOP voting for the same ol' BS you get from dems and reps. A Constitutional examination will show the EPA is ILLEGAL! Castle2016.com
